Welcome to CSmile Dental Lab. By accessing and using our website csdentlab.com and our dental laboratory services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services. These terms constitute a legally binding agreement between you (“Client,” “you”) and CSmile Dental Lab (“we,” “us,” “our”).
- About Us
CSmile Dental Lab is a B2B dental laboratory providing custom dental fabrication services to licensed dental professionals and clinics worldwide. We are FDA-registered and ISO 13485 certified. Our manufacturing facility produces dental crowns, bridges, implants, dentures, orthodontic appliances, and clear aligners.
- Eligibility
Our services are available exclusively to licensed dental professionals, dental clinics, and authorized dental distributors. By placing an order, you confirm that you are a licensed dental professional or an authorized representative of a dental clinic. We reserve the right to verify professional credentials before accepting orders.
- Services and Orders
4.1 Quote Requests: Pricing for dental laboratory services is provided through individual quotes. You may request a quote through our website or by contacting us directly. Quotes are valid for 30 days from the date of issuance.
4.2 Order Placement: Orders must include complete case information, including digital scans (STL files), impressions, prescriptions, shade specifications, and delivery instructions. Incomplete or unclear case information may result in manufacturing delays or remakes at the client’s expense.
4.3 Order Confirmation: All orders are subject to acceptance by CSmile Dental Lab. We reserve the right to decline orders for any reason, including cases that do not meet our technical specifications or regulatory requirements.
4.4 Digital Files: You are responsible for the accuracy of all digital files, scans, and prescriptions submitted. CSmile Dental Lab is not liable for errors resulting from incorrect or incomplete case information provided by the client.
- Pricing and Payment
5.1 Pricing: All prices are quoted in US Dollars (USD) unless otherwise specified. Prices are subject to change without notice. The price in effect at the time of order confirmation will apply.
5.2 Payment Terms: Payment terms will be specified in the quote or invoice. Unless otherwise agreed, payment is due upon invoice for new clients. Established accounts may be eligible for net-30 payment terms subject to credit approval.
5.3 Late Payments: overdue payments may incur a late fee of 1.5% per month or the maximum rate permitted by law, whichever is lower.
5.4 Taxes: Clients are responsible for any applicable taxes, customs duties, or import fees associated with their orders.
- Manufacturing and Quality
6.1 Quality Standards: All dental products are manufactured in compliance with FDA regulations and ISO 13485 quality management standards. Each case undergoes quality inspection before shipping.
6.2 Materials: We use FDA-approved materials from certified suppliers. Material specifications will be confirmed in the order quote. Clients may request specific material brands subject to availability and additional cost.
6.3 Remake Policy: If a dental product does not meet the specifications provided in the original case submission, we will remake it at no additional cost, provided the remake request is submitted within 14 days of receipt. Remakes due to client error (e.g., incorrect impression, wrong shade) will be charged at full price.
6.4 Warranty: Dental products carry a manufacturer’s warranty as specified in the individual product documentation. Warranty does not cover damage caused by improper handling, adjustment, or cementation by the dental professional.
- Shipping and Delivery
7.1 Shipping Methods: We ship via FedEx and other major carriers. Shipping costs are calculated based on destination, weight, and selected service level. Clients may specify their preferred shipping account.
7.2 Turnaround Time: Standard turnaround times vary by product type and will be communicated at order confirmation. Turnaround times are estimates and not guaranteed unless expressly stated in writing.
7.3 International Shipping: For international orders, the client is responsible for ensuring compliance with import regulations in their country. CSmile Dental Lab is not responsible for delays caused by customs clearance.
7.4 Risk of Loss: Risk of loss passes to the client upon delivery to the shipping carrier. We recommend selecting insured shipping for valuable cases.
- Returns and Refunds
Due to the custom nature of dental laboratory products, all sales are final unless the product does not meet the submitted specifications (see Remake Policy, Section 6.3). Refunds for non-conforming products will be processed as remakes rather than monetary refunds, at our discretion.
- Intellectual Property
9.1 Website Content: All content on csdentlab.com, including text, graphics, logos, images, and design elements, is the property of CSmile Dental Lab and is protected by copyright and trademark laws. You may not reproduce, distribute, or use our content without prior written permission.
9.2 Client Materials: Clients retain ownership of all digital files, scans, and case information submitted to us. By submitting these materials, you grant CSmile Dental Lab a limited license to use them solely for the purpose of fulfilling your order.
9.3 Manufacturing Processes: Our manufacturing techniques, workflows, and proprietary processes are the intellectual property of CSmile Dental Lab and may not be replicated or disclosed to third parties.
- Confidentiality and Patient Data
We treat all client and patient information as confidential. Patient-identifying information is handled in accordance with HIPAA and applicable data protection laws. We do not access, use, or disclose patient information except as necessary to fulfill the dental laboratory order. See our Privacy Policy for detailed information on data handling.
- Limitation of Liability
To the maximum extent permitted by law, CSmile Dental Lab shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services or products. Our total liability for any claim shall not exceed the amount paid by the client for the specific order giving rise to the claim. We are not liable for clinical outcomes, as dental products are professional components requiring proper clinical application by licensed dental professionals.
- Indemnification
The client agrees to indemnify and hold harmless CSmile Dental Lab, its officers, employees, and agents from any claims, damages, liabilities, or expenses (including legal fees) arising from: (a) inaccurate or incomplete case information provided by the client; (b) improper clinical use of our products; (c) breach of these Terms and Conditions; or (d) violation of applicable laws or regulations.
- Force Majeure
We shall not be liable for delays or failures to perform our obligations due to causes beyond our reasonable control, including but not limited to natural disasters, pandemics, labor disputes, supply chain disruptions, government actions, or failures of third-party service providers.
- Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by the laws applicable to the jurisdiction where CSmile Dental Lab is registered, without regard to conflict of law principles. Any disputes arising from these terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with applicable commercial arbitration rules.
- Account Termination
We reserve the right to suspend or terminate access to our website and services for any client who violates these Terms and Conditions, engages in fraudulent activity, or fails to maintain professional licensing requirements. Upon termination, all outstanding invoices become immediately due.
- Changes to Terms
We may update these Terms and Conditions at any time. Changes become effective immediately upon posting on our website. Continued use of our services after changes are posted constitutes acceptance of the updated terms. We encourage you to review this page periodically.
- Severability
If any provision of these Terms and Conditions is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
